1. Introduction and Acceptance of Terms

Welcome to the CC&C Solutions Training Platform ArchIQ (the “Platform"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "Learner", or "User") and CC&C Solutions Pty Ltd (ABN 65 096 869 680) ("CC&C", "we", "us", or "our").

By accessing or using our Platform, creating an account, or enrolling in any course, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

We reserve the right to modify these Terms at any time. Material changes will be notified via email or Platform notification at least fourteen (14) days before taking effect. Your continued use of the Platform following such notification constitutes acceptance of the modified Terms.

2. Definitions

In these Terms, unless the context otherwise requires:


  • "Course" means any online training program, module, certification, or educational content offered through the Platform.
  • "Course Materials" means all videos, presentations, worksheets, assessments, documentation, and any other content provided as part of a Course.
  • "Access Period" means the period during which you are entitled to access a Course, as specified at the time of enrolment (typically six months unless otherwise stated).
  • "Account" means your personal user account on the Platform.
  • "Intellectual Property" means all patents, trademarks, trade names, copyright, moral rights, designs, trade secrets, know-how, and all other intellectual property rights, whether registered or unregistered.

3. Account Registration and Eligibility

3.1 Eligibility

To use the Platform, you must be at least eighteen (18) years of age and have the legal capacity to enter into binding contracts. By registering, you represent and warrant that you meet these eligibility requirements.

3.2 Account Creation

You must provide accurate, current, and complete information during registration. Each Account is personal to you and may not be shared with, transferred to, or used by any other person. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.

3.3 Account Security

You must immediately notify us at support@ccandcsolutions.com if you become aware of any unauthorised use of your Account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your Account credentials.

4. Course Access and Licence

4.1 Licence Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Course Materials for your personal, non-commercial educational purposes during the Access Period.

4.2 Access Period

Unless otherwise specified, your Access Period is six (6) months from the date of enrolment. Upon expiration, your access to Course Materials will automatically terminate.
Extensions or re-enrolment may be available at our discretion and may incur additional fees.

4.3 Technical Requirements

You are responsible for ensuring you have a compatible device, stable internet connection, and current web browser to access the Platform. We do not guarantee uninterrupted access and are not liable for any inability to access the Platform due to technical issues on your end.


5. Fees, Payment, and Refunds

5.1 Course Fees

Course fees are as stated on the Platform at the time of enrolment. All fees are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. We reserve the right to change fees at any time, though changes will not affect existing enrolments.

5.2 Payment

Payment must be made in full at the time of enrolment unless instalment arrangements have been expressly agreed in writing. We accept payment via the methods specified on the Platform. You warrant that you are authorised to use the payment method provided.

5.3 Refund Policy

You may request a full refund within fourteen (14) days of enrolment, provided you have not accessed more than 10% of the Course Materials. Refund requests must be submitted in writing to support@ccandcsolutions.com. Refunds will be processed within fourteen (14) business days using the original payment method. After the 14-day period or if more than 10% of Course Materials have been accessed, no refunds will be provided except as required by Australian Consumer Law.

6. User Obligations and Conduct

6.1 Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must:

  • Provide accurate and truthful information in your Account and any assessments
  • Complete Course assessments and certifications through your own efforts without external assistance unless expressly permitted
  • Respect the intellectual property rights of CC&C and third parties
  • Comply with all applicable laws and regulations

6.2 Prohibited Activities

You must not:
  • Share your Account credentials or allow others to access the Platform using your Account
  • Copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any Course Materials
  • Record, screenshot, or capture any video, audio, or other Course content
  • Use automated tools, bots, or scripts to access the Platform or download content
  • Attempt to circumvent any security measures or access restrictions
  • Use the Platform in any manner that could damage, disable, or impair its operation
  •  Engage in any conduct that is fraudulent, abusive, or otherwise harmful to CC&C or other users
Any violation of the above prohibited activities may result in your account being suspended and access to the Platform revoked without any refund.

7. Intellectual Property Rights

7.1 Ownership

All Course Materials, Platform content, trademarks, logos, and other Intellectual Property are owned by or licensed to CC&C Solutions and are protected by Australian and international copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.


7.2 Restrictions

Except as expressly permitted in these Terms, you may not:

  • Modify, adapt, translate, or create derivative works based on any Course Materials
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use any CC&C trademarks or branding without prior written consent
  • Reverse engineer, decompile, or disassemble any Platform software or technology

7.3 Third-Party Content

Courses may reference third-party standards, frameworks, or materials (including BIAN standards). Such third-party content remains the property of their respective owners and is subject to their terms of use.


8. Certifications and Credentials

Upon successful completion of applicable assessments, you may receive a certificate of completion or other credential. Such certificates are issued in your name only and may not be transferred. We reserve the right to revoke any certificate obtained through fraud, misrepresentation, or violation of these Terms. Certificates represent completion of CC&C training and do not constitute professional licensure or accreditation unless expressly stated.


9. Disclaimers

9.1 Course Content

Course Materials are provided for general educational purposes only and do not constitute professional advice. While we endeavour to ensure accuracy, we make no warranties regarding the completeness, reliability, or suitability of Course content for any particular purpose. You should seek independent professional advice before making decisions based on Course content.


9.2 Platform Availability

The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, secure, or error-free access. We may suspend or discontinue the Platform or any Course at any time without notice for maintenance, updates, or other reasons

9.3 No Guarantees

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any guarantee of specific learning outcomes, career advancement, or professional success
  • Any representation that Course content will meet your specific requirements

10. Limitation of Liability

To the maximum extent permitted by law, CC&C, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Platform, even if advised of the possibility of such damages.

Our total aggregate liability for any claims arising from these Terms or your use of the Platform shall not exceed the total fees paid by you for the relevant Course in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability under the Australian Consumer Law for goods or services that do not meet consumer guarantees.


11. Indemnification

You agree to indemnify, defend, and hold harmless CC&C, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any applicable law or the rights of any third party; (c) your use of the Platform; or (d) any content you submit or share through the Platform.


12. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, available at https://ccandcsolutions.com by clicking on the Privacy Policy link in the site footer. By using the Platform, you consent to our collection and use of your information as described in the Privacy Policy.

We may collect data about your Course progress, assessment results, and Platform usage to improve our services and provide you with a personalised learning experience.

13. Termination

13.1 Termination by You

You may terminate your Account at any time by contacting us at support@ccandcsolutions.com. Termination does not entitle you to a refund except as provided in Section 5.3.


13.2 Termination by Us

We may suspend or terminate your Account and access to the Platform immediately and without notice if:

  • You breach any provision of these Terms
  • We reasonably believe you have engaged in fraudulent or unlawful activity
  • Your Access Period expires
  • We discontinue the Platform or relevant Course

13.3 Effect of Termination

Upon termination, your licence to access Course Materials immediately ceases. Provisions of these Terms that by their nature should survive termination (including Sections 7, 9, 10, 11, and 14) shall continue in effect.


14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal from them.

14.2 Dispute Resolution

Before commencing legal proceedings, you agree to attempt to resolve any dispute by first contacting us at support@ccandcsolutions.com. If the dispute is not resolved within thirty (30) days, either party may pursue formal legal remedies

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any Course-specific terms, constitute the entire agreement between you and CC&C regarding the Platform and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of CC&C.

15.4 Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet or telecommunications failures, or pandemics.
